Question:

I need a fatwa on the permissibility on Dropshipping.

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

The standard model of drop shipping is not permissible because you are not allowed to sell something you do not own.

Here’s a Shariah compliant alternative: conducting a ‘Salam’ contract would make it permissible. To do this you will need to do the following;

1. Describe the item, mentioning you do not have the item in your possession and will arrange to have it purchased and delivered after receiving payment.
2. Once you receive payment, purchase the item yourself.
3. Once the item has been purchased by yourself, then arrange the delivery to the buyer.

These are some of the main rules for a Salam contract. I would advise seeking further support in relation to Salam transactions.

ويشترط لصحة البيع أن يكون المبيع مملوكا للبائع، وأن يكون البائع قد قبض المبيع حقيقة أو حكما، فمن اشترى شيئا وباعه إلى أحد قبل أن يقبضه فالبيع فاسد، والقبض الحقيقي أن يكون المبيع في حيازته حسا، والقبض الحكمي التخلية، وهي أن يمكنه البائع من القبض الحسي متى شاء بدون مانع، والتخلية تقوم مقام القبض في جميع المبيعات إلا في الصرف.

…وعدم ضمان المشتري يدل على عدم قبضه للمبيع، لأن الضمان يتبع القبض، فإن باعه المشتري إلى آخر، فإنه من قبيل ربح ما لم يضمنه
