Income From Dropshipping

Question:

 

If someone was receiving money from another person but their income consisted of dropping shipping, in store sales and receiving rent from their houses. Are we allowed to take this money?

 

Because the person receiving the money believes that more than 50% of the income is most likely haram.

 

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

Whatever income is haram then it is forbidden to consume. If part of a person’s income is haraam then that makes all the income haram.

 

The person receiving the money would need to establish if their money is haraam or halaal.

 

As for the money being gifted to you, you have no ownership of the money being given to you. Most importantly the person gifting the money would need to establish if the money being given is halaal or not. If most of the money is not halaal then it will not be permissible to take it a gift. If it apparent to be from the haram portion of wealth, then the person being gifted to is not to accept.

 

If the money is from halaal sources and is being gifted to you, then you are allowed to accept it.

1 فَالْمُسْتَصْنَعُ فِيهِ مَبِيعٌ عَيْنٌ وَلِهَذَا يَثْبُتُ فِيهِ خِيَارُ الرُّؤْيَةِ وَالْعَمَلُ مَشْرُوطٌ فِيهِ وَهَذَا؛ لِأَنَّ هَذَا النَّوْعُ مِنْ الْعَمَلِ اخْتَصَّ بِاسْمٍ فَلَا بُدَّ مِنْ اخْتِصَاصِهِ بِمَعْنًى يَقْتَضِيهِ ذَلِكَ الِاسْمُ، وَالِاسْتِصْنَاعُ اسْتِفْعَالٌ مِنْ الصُّنْعِ فَعَرَفْنَا أَنَّ الْعَمَلَ مَشْرُوطٌ فِيهِ، ثُمَّ أَحْكَامُ مَا لِلنَّاسِ فِيهِ تَعَامُلٌ مِنْ الِاسْتِصْنَاعِ قَدْ بَيَّنَّاهُ فِي شَرْحِ الْبُيُوعِ 

 

 

2 ؛ لِأَنَّ الِانْتِفَاعَ بِهَا لَا يَكُونُ إلَّا بِاسْتِهْلَاكِ عَيْنِهَا وَلَا يَجُوزُ أَنْ يَسْتَحِقَّ بِالْإِجَارَةِ اسْتِهْلَاكَ الْعَيْنِ وَلَا أَجْرَ عَلَيْهِ؛ لِأَنَّ الْعَقْدَ لَمْ يَنْعَقِدْ أَصْلًا لِانْعِدَامِ مَحَلِّهِ فَمَحَلُّ الْإِجَارَةِ مَنْفَعَةٌ تَنْفَصِلُ عَنْ الْعَيْنِ بِالِاسْتِيفَاءِ، وَلَيْسَ لِهَذِهِ الْأَمْوَالِ مَنْفَعَةٌ مَقْصُودَةٌ تَنْفَصِلُ عَنْ الْعَيْنِ وَبِدُونِ الْمَحَلِّ لَا يَنْعَقِدُ الْعَقْدُ وَهُوَ ضَامِنٌ لِلْمَالِ؛ لِأَنَّ الْعَقْدَ لَمَّا صَارَ لَغْوًا بَقِيَ مُجَرَّدُ الْإِذْنِ فَكَأَنَّهُ أَعَارَهُ إيَّاهُ، وَقَدْ بَيَّنَّا أَنَّ الْعَارِيَّةَ فِي الْمَكِيلِ وَالْمَوْزُونِ قَرْضٌ
