Question:

 

If a person considers it halal for a muslim man to marry kaffira not a Jew or Christian, will he be kaffir?

 

 

In the name of Allah, the Most Gracious, the Most Merciful.

 

 

Answer:

 

The Qur’an is clear that the Muslim man is only permitted to marry a Muslim woman or a woman from the Ahle Kitab, i.e. a Jewish or Christian woman, provided they believe in it and uphold the basic commandments [1].

 

Thus, the one who rejects this and claims that it is Halal to marry a non-Muslim woman who is not from the Ahle Kitab is rejecting the verses of the Qur’an, rejecting the words of Allah s.w.t and therefore exiting from the fold of Islam [2].

 

However, one should take utmost caution when applying the label of Kuffar. If the individual in question made this claim with no knowledge of the Qur’an or classical ruling whilst in such a position where they could not have reasonably learnt the truth before making such a claim, then leeway may be given provided they accept the correct ruling once it has been demonstrated to them [3].

Surah Al-Ma’idah 5:

{ الْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ ۖ وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَّكُمْ وَطَعَامُكُمْ حِلٌّ لَّهُمْ ۖ وَالْمُحْصَنَاتُ مِنَ الْمُؤْمِنَاتِ وَالْمُحْصَنَاتُ مِنَ الَّذِينَ أُوتُوا الْكِتَابَ مِن قَبْلِكُمْ إِذَا آتَيْتُمُوهُنَّ أُجُورَهُنَّ مُحْصِنِينَ غَيْرَ مُسَافِحِينَ وَلَا مُتَّخِذِي أَخْدَانٍ ۗ وَمَن يَكْفُرْ بِالْإِيمَانِ فَقَدْ حَبِطَ عَمَلُهُ وَهُوَ فِي الْآخِرَةِ مِنَ الْخَاسِرِينَ ۞}

 

[2] Surah Al-Ma’idah 44:

{ … وَمَن لَّمْ يَحْكُم بِمَا أَنزَلَ اللَّهُ فَأُولَٰئِكَ هُمُ الْكَافِرُونَ ۞}

 

Surah Al-Baqarah 85:

{ … أَفَتُؤْمِنُونَ بِبَعْضِ الْكِتَابِ وَتَكْفُرُونَ بِبَعْضٍ ۚ فَمَا جَزَاءُ مَن يَفْعَلُ ذَٰلِكَ مِنكُمْ إِلَّا خِزْيٌ فِي الْحَيَاةِ الدُّنْيَا ۖ وَيَوْمَ الْقِيَامَةِ يُرَدُّونَ إِلَىٰ أَشَدِّ الْعَذَابِ ۗ وَمَا اللَّهُ بِغَافِلٍ عَمَّا تَعْمَلُونَ ۞}

 

Surah An-Nisa’ 150-151:

{ إِنَّ الَّذِينَ يَكْفُرُونَ بِاللَّهِ وَرُسُلِهِ وَيُرِيدُونَ أَن يُفَرِّقُوا بَيْنَ اللَّهِ وَرُسُلِهِ وَيَقُولُونَ نُؤْمِنُ بِبَعْضٍ وَنَكْفُرُ بِبَعْضٍ وَيُرِيدُونَ أَن يَتَّخِذُوا بَيْنَ ذَٰلِكَ سَبِيلًا ۞ أُولَٰئِكَ هُمُ الْكَافِرُونَ حَقًّا ۚ وَأَعْتَدْنَا لِلْكَافِرِينَ عَذَابًا مُّهِينًا ۞}

 

[3] Surah Al-Baqarah 286:

{ لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا … }
