Question:

 

When wearing the niqab cap, the niqab would inevitably touch parts of her face during parts of the day e.g. if she is walking against the wind etc. Would a person wearing a niqab cap therefore need to give sadaqah for every day?

 

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

If she covers it for less than one hour, she will need to give sadaqah equivalent to the amount of sadaqat al-fitr, based on the more cautious opinion.

 

If it touches her face for more than one hour but less than 12 hours, she will need to compensate by offering sadaqah.

 

If it touches her face for a full day or night, which is 12 hours or more, she must compensate by offering a dam.

 

The calculation of 12 hours will be considered if it was worn continuously without interruption. If it was removed for a necessity and then worn again, the 12-hour calculation will start anew.

«أَوْ سَتَرَ رَأْسَهُ) بِمُعْتَادٍ إمَّا بِحَمْلِ إجَّانَةٍ أَوْ عِدْلٍ فَلَا شَيْءَ عَلَيْهِ (يَوْمًا كَامِلًا) أَوْ لَيْلَةً كَامِلَةً، وَفِي الْأَقَلِّ صَدَقَةٌ (وَالزَّائِدُ) عَلَى الْيَوْمِ (كَالْيَوْمِ)

«قَوْلُهُ يَوْمًا كَامِلًا أَوْ لَيْلَةً) الظَّاهِرُ أَنَّ الْمُرَادَ مِقْدَارُ أَحَدِهِمَا فَلَوْ لَبِسَ مِنْ نِصْفِ النَّهَارِ إلَى نِصْفِ اللَّيْلِ مِنْ غَيْرِ انْفِصَالٍ أَوْ بِالْعَكْسِ لَزِمَهُ دَمٌ كَمَا يُشِيرُ إلَيْهِ قَوْلُهُ وَفِي الْأَقَلِّ صَدَقَةٌ شَرْحُ اللُّبَابِ (قَوْلُهُ وَفِي الْأَقَلِّ صَدَقَةٌ) أَيْ نِصْفُ صَاعٍ مِنْ بُرٍّ، وَشَمِلَ الْأَقَلُّ السَّاعَةَ الْوَاحِدَةَ أَيْ الْفَلَكِيَّةَ وَمَا دُونَهَا خِلَافًا لِمَا فِي خِزَانَةِ الْأَكْمَلِ أَنَّهُ فِي سَاعَةٍ نِصْفُ صَاعٍ وَفِي أَقَلَّ مِنْ سَاعَةٍ قَبْضَةٌ مِنْ بُرٍّ. اهـ. بَحْرٌ، وَمُشِيَ فِي اللُّبَابِ عَلَى مَا فِي الْخِزَانَةِ، وَأَقَرَّهُ شَارِحُهُ، وَاعْتَرَضَ بِمُخَالَفَتِهِ لِمَا ذَكَرَهُ الْفُقَهَاءُ»

 

«بدائع الصنائع في ترتيب الشرائع» (2/ 187):

«وَكُلُّ صَدَقَةٍ تَجِبُ بِفِعْلِ مَا يَحْظُرُهُ الْإِحْرَامُ فَهِيَ مُقَدَّرَةٌ بِنِصْفِ صَاعٍ إلَّا مَا يَجِبُ بِقَتْلِ الْقَمْلَةِ وَالْجَرَادَةِ»
