Question:
A musafir will return home on the 12th day of Dhul Hijjah. When he returns Qurbani will be waajib upon him.
1) Can he do his (Waajib) Qurbani whilst on Safar.
2) Can he ask someone at home to do his (Waajib) Qurbani on the 10th or 11th before his return on the 12th?

Answer:
Qurbani is not obligatory for a Shar’ī traveller. A Shar’ī traveller is someone who intends to travel 48 miles and is considered a traveller as soon as they leave their town.
Even if Qurbani is not obligatory for someone, it is highly virtuous to perform the sacrifice, and they will receive the rewards mentioned in the Ahadīth. If a traveler returns home on the 12th of Dhul Hijjah before sunset, Qurbani becomes obligatory for them at that moment. In this case, the aforementioned person can either do Qurbani as soon as he returns or get someone to do it on his behalf when he returns. If he does it before, it won’t suffice for his wajib.
A traveller who decides to stay at a particular place for fifteen days or more is no longer considered a traveler and must perform Qurbani if they possess the specified amount of wealth.
ولا أضحية على المسافر، وإن كان له أولاد بعضهم معه، وبعضهم في المصر، فليس عليه أن يضحي عن الأولاد الذين معه، وعليه أن يضحي عن المقيمين في المصر، وهذا على الرواية التي توجب الأضحية على الأب عن الولد الصغير، واعتبر حال من يضحى عنه لا حال المضحي في «القدوري» .
[الأضحية على الفقير والمسافر]
م: (قال: وليس على الفقير والمسافر أضحية) ش: أي قال القدوري م: (لما بينا) ش: أشار به إلى قوله: واليسار ولما روينا والإقامة لما بينا م: (وأبو بكر وعمر ﵄ كانا لا يضحيان إذا كانا مسافرين) ش: هذا لم يثبت عنهما بهذه العبارة، ولا ذكره أهل الحديث، وإنما الذي ذكره عن أبي شريحة الغفاري أنه قال: أدركت أو رأيت أبا بكر ﵁ وعمر ﵁ لا يضحيان. وقد ذكرناه فيما مضى وهذا أعم من الإقامة والسفر م: (وعن علي ﵁: ليس على المسافر جمعة ولا أضحية) ش: هذا أيضا لم يثبت عن علي ﵁.
