Talaq Via A Text Message

Question:

During an argument, she kept asking me to give her divorce. I remained silent for a few days because I didn’t want to divorce her, and it was anger on her part due to some misunderstandings, so she was pushing me almost every day to say three words via text message.

 

On December 26, 2023, I sent her the following message:

If you made up your mind, I can’t help, and I can only wish you good luck. I tried my best, but if you want to end this way, then I have no other option to free you from the relationship you don’t want to keep. Allah best knows my intentions I always been positive, and I hereby give you Kiran baig. I am giving you first divorce, and I am giving you a second divorce. I am giving you a third divorce. Whatever amount of haq mahr I will post you, and you can keep the ring as well.

It was only one occasion i sent above message to her.

 

Since then, she has been asking me to come back, and she has been sending me messages every day, but I have never responded until Eid Mubarak on the last Eid 11-4-2024.

 

Please let me know what is marriage or divorce validity in Islam.

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

In principle, as a  husband your  3 divorces, constitute a Talaaq-e-mughallazah (an irrevocable divorce). The implications there of being that the Nikah  is terminated at that point and the spouses cannot live together as husband and wife.[i]

 

 

Only Allah (عز و جل) knows best.
