Talaq Kinayah, OCD, and Waswas: Clarifications on Implicit Divorce and Mental Health

Question:

Assalamualaikum Mufti sahab,

I have a few questions:

Does typing or pressing the symbol ‘X’ count as typing a kinayah word?

While reading Salah, I pray Surah Al-Kawthar, in which in the second ayah we have “وَٱنۡحَرۡ”, does saying this count as kinayah?

I searched Google and the word means “to sacrifice”. Is “sacrifice” a kinayah word?

I have an OCD problem which I’ve been suffering from for 2 to 3 years now. Am I considered a ma’zoor in this case? Will having waswas of niyyah, or the terms coming to mind as a statement of niyyah, while saying these terms be considered an intention (niyyah) or just waswas?

I am having serious trouble and it’s affecting both my deen and my dunya.

Please answer all the above questions.

Answer:

Wa alaykum Assalaam

Talaq Kinayah / Implicit Divorce

For a statement to be considered a kinayah (indirect) form of talaq, it has to be a statement that does not explicitly refer to talaq but could suggestively imply talaq in an indirect sense.

Examples:

“Leave and move back with your family.”

“You are free and single.”

Neither the symbol “X” nor the word “وانحر” (sacrifice) implies talaq in any way whatsoever.

Thus, neither word constitutes talaq, no matter what your intention is when uttering or typing these words.

Obsessive Compulsive Disorder (OCD)

As for your second question, talaq occurs from any person who is:

Mature (has reached puberty)

Rational (has intellect and is not mentally insane)

You are not a ma’zoor (excused) in the legal sense that would invalidate a talaq if you were to pronounce it. Therefore, if you do pronounce a statement of talaq to your wife, it will occur and be binding, as you are considered mentally rational—even if Shaytan constantly whispers doubts into your mind.

You need to:

Fight your waswasa and ignore the whispers caused by Shaytan.

Seek medical help for your OCD.

Stay in constant dhikr (remembrance of Allah) to ward off the whispers of Shaytan.

Allah Ta’ala says in the Noble Quran:

{ وَمَن یَعۡشُ عَن ذِكۡرِ ٱلرَّحۡمَـٰنِ نُقَیِّضۡ لَهُۥ شَیۡطَـٰنࣰا فَهُوَ لَهُۥ قَرِینࣱ }
“And whoever is blinded from remembrance of the Most Merciful – We appoint for him a devil, and he is to him a companion.”
[Surah Az-Zukhruf: 36]

Recite your daily adhkar and wazifah duas to protect yourself from Shaytan.

Finally, treat these thoughts as waswasa, and NOT as actual intentions of talaq. Seek immediate help from a doctor so that your brain is not constantly burdened with these doubts about your marriage.
