Question:
About two months ago, I accidentally hit my wife over something, and she got angry and went to her room without telling me and sat there in a rage. I tried very hard to convince her, but nothing worked, so in a fit of rage, I got a divorce certificate drawn up and sent a photocopy by post, and she received it. Now I want to return and my wife also wants to return. My question is, are we divorced or not? Can we return again or not, while we have a daughter who is also living with her mother at her grandfather’s house?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
The giving of the divorce certificate will be considered as sufficient for one revocable Talaq. This means that you and your wife may return to each other without renewing the Nikkah within the waiting period (three menstrual cycles). If the waiting period (three menstrual cycles) has passed, then there must be a new Nikkah before you get back together.
