Question

السلام عليكم شيخنا

I have an investment opportunity with a company that buys a certain currency and sells when the price is right.

As you can see in the photo, in the first column it shows which currency is being used and bought, and in the last column, it shows the profit or loss.

 

He is offering to pay 5% every 10 weeks on my investment because of the experience he has had over the years of trading, and he takes anything above 5%. In the case of making less than 5% of my investment, he will pay me it completely. So, for example, if I invest $100,000, he will buy and sell the currency with that money and pay me 5% of my investment which will be $5000 and profit any amount made above that. If the investment profits less than $5000, then I profit whatever is made.

Answer:

Trading in currencies of different countries in light of the scenario given in the question is permissible[1] with the following conditions:

 

  1. At least one of the parties involved in the transaction must take possession of its desired currency at the time of the transaction. Departing with neither of the parties taking possession of a currency is not permissible.[2]
  2. The rate at which the two currencies are being exchanged should match the exchange rates stipulated by the government as the market exchange rate.[3]
  3. The profit share must not be fixed, rather it should be agreed that a particular percentage of the profits will be the client’s share. For example, it is not permissible to state $5000 will be given to the client but rather 15% of the profit will be for them.

[2] ثم إن هذه الأوراق النقدية، وإن كان لا يجوز فيها التفاضل، ولكن بيعها ليس بصرف، فلا يشترط فيه التقابض في مجلس العقد، نعم يشترط قبض أحد البدلين عند الإمام أبي حنيفة وأصحابه؛ لأن الفلوس عندهم لا تتعين بالتعيين، فلو افترقا دون أن يقبض أحد البدلين، لزم الافتراق عن دين بدين (بحوث في قضايا فقهية معاصرة ج 1 ص 167. مكتبة دار العلوم كراتشي).

 

 

[3] ثم إن أسعار هذه العملات بالنسبة إلى العملات الأخرى، ربما تعين من قبل الحكومات، فهل يجوز بيعها بأقل أو أكثر من ذلك السعر المحدد؟ والجواب عندي أن البيع بخلاف هذا السعر الرسمي لا يعتبر ربا؛ لما قدمنا من أنها أجناس مختلفة، ولكن تجري عليه أحكام التسعير، فمن جوز التسعير في العروض، جاز عنده هذا التعسير أيضا، ولا ينبغي مخالفة هذا السعر، إما لأن طاعة الإمام فيما ليس بمعصية واجب، وإما لأن كل من يسكن دولة فإنه يلتزم قولا أو عملا بأنه يتبع قوانينها، وحينئذ يجب عليه اتباع أحكامها، مادامت تلك القوانين لا تجبر على معصبة دينية (بحوث في قضايا فقهية معاصرة ج 1 ص 166-167. مكتبة دار العلوم كراتشي).
