Qasar Salah Confusion at Hajj after Different Replies From Muftis

Question

We have been to Haj and according to my calculation, we were supposed to stay for 14 days in Makkah before leaving to Mina.

I was unaware of Qasar salah rules, so there was some confusion.

The beginning couple of days my family were reading full until I told them, then they started Qasar. During Haj too they were praying Qasar. Until some mufti told me you should calculate the day of travel also, which makes it 15 days. (I was unaware of the rulings of Qasar that if the intention is not fixed to 15 or more, you should pray Qasar).

I got confused and read 2-3 full Salah and later again checked with another mufti, and he said you can read Qasar as per your 14-day calculation.

Makkah stay: 5-18 AUG, Hajj: 19-23, Makkah: 23rd evening-4th SEP, 5-13 SEP: Medina.

So, in summary, 5,6 (full Salah), (7-21 (Qasar Salah)), 22-23 (few full Salah) ,23-4 (Qasar Salah)), 5-13 (Qasar)

1. Are all Salah's valid including the full salahs at the beginning and in between which were offered due to ignorance/confusion?

2. Does it have any effect on the Hajj?

Answer:

In relation to the above questions:

  1. All the salats will be considered valid.
  2. The salats will have no effect on the validity of Hajj.

The messenger of Allah may peace and blessings be upon him has said: “When a judge gives a decision, having tried his best to decide correctly and is right, there are double rewards for him; and if he gave a judgment after having tried his best (to arrive at a correct decision) but erred, there is one reward for him.”[1]

And in relation to the differences between a judge and a mufti in shariah, Imam Ibn Salaah mentions:

The verdict of a Mufti is not strictly binding for the recipient like the verdict of a judge.”[2]

Allah says in the Holy Quran: “Allah does not burden a soul except with that which it can bear. It will have [the consequence of] what [good] it has gained, and it will bear [the consequence of] what [evil] it has earned. "Our Lord, do not hold us accountable if we have forgotten or stumbled.”[3]
