Question:
Salamu’aleykoum Three years ago I threatened my wife with divorce if she contacted someone I didn’t like, something she did without my knowledge, now I’m hesitating how to pronounce it. I don’t know if I should say I’m going to divorce you or I’m going to divorce you if she contacts the person, I’m already divorced twice, I’m afraid of separating from my wife and children, I don’t want to get divorced, is there a reliable opinion from a scholar that I can follow to keep my marriage
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
I understand the situation you are in is difficult. I pray Allah ta’ala grants you ease and tranquillity, Ameen.
Regarding a conditional divorce, if the divorce was stipulated with a condition, then upon the condition being met the divorce will take place. If the statement was a threat without the word “if” then it will be down to your intention at the time, if you meant divorce then divorce will take place if not then it won’t be.
E.g.
– “If you contact someone, the I will divorce you” = Divorce will take place upon contact of said person
– “Don’t contact someone, I will divorce you” = Intention will be taken into consideration.
Please note that if all three Talaqs are issued then the marriage will come to a complete end, and the couple must separate immediately.

وَإِذَا كَانَ الْجَزَاءُ فِعْلًا إمَّا فِعْلٌ مُسْتَقْبَلٌ أَوْ فِعْلٌ مَاضٍ فَالْجَزَاءُ يَتَعَلَّقُ بِالشَّرْطِ بِدُونِ حَرْفِ الْفَاءِ وَيُبْتَنَى عَلَى هَذَا الْأَصْلِ مَا إذَا قَالَ لَهَا: إنْ دَخَلْتُ الدَّارَ وَأَنْتِ طَالِقٌ فَإِنَّهَا تَطْلُقُ لِلْحَالِ وَإِنْ قَالَ: عَنَيْتُ التَّعْلِيقَ لَا يَدِينُ أَصْلًا هَكَذَا ذُكِرَ فِي الْجَامِعِ وَبَعْضُ مَشَايِخِنَا قَالُوا: يُسْأَلُ الزَّوْجُ كَيْفَ نَوَيْتَ إنْ قَالَ: بِإِضْمَارِ حَرْفِ الْفَاءِ لَا تَصِحُّ نِيَّتُهُ أَصْلًا وَإِنْ كَانَ بِالتَّقْدِيمِ وَالتَّأْخِيرِ تَصِحُّ نِيَّتُهُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ – تَعَالَى – وَكَذَلِكَ إذَا قَالَ لَهَا: فَإِنْ دَخَلْتُ الدَّارَ أَنْتِ طَالِقٌ تَطْلُقُ لِلْحَالِ. وَإِنْ عَنَى التَّعْلِيقَ دِينَ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ – تَعَالَى – وَكَذَلِكَ إذَا قَالَ لَهَا: أَنْتِ طَالِقٌ وَإِنْ دَخَلْتُ الدَّارَ فَإِنَّهَا تَطْلُقُ لِلْحَالِ وَإِنْ عَنَى التَّعْلِيقَ لَا يَدِينُ أَصْلًا لَا فِي الْقَضَاءِ وَلَا فِيمَا بَيْنَهُ وَبَيْنَ رَبِّهِ وَلَمْ يَذْكُرْ مُحَمَّدٌ –
