Question:
A woman is iddah at her husband’s apartment. The lease is set to end during the middle of the iddah… can she go stay at her parents house if her husband is planning to go and stay with his parents after the lease ends?

Answer:
After a husband issues a Talaq (divorce) to his wife, she must reside in the house in which she was divorced for the duration of her Iddah (waiting period). The husband is obliged to financially support her during this time, i.e., he must provide her with food, clothing and shelter until the end of her Iddah. Furthermore, the wife is not permitted to leave the husband’s house unless she faces dire circumstances. [1]
In your scenario, if the apartment lease is ending and the husband refuses to extend the lease and continue providing adequate shelter for the wife, she may leave and observe the remainder of her Iddah at her parents’ house. [2]
The wife must treat her parents’ residence like her original place of Iddah and observe all the laws concerning Iddah. [3] In other words, she is NOT permitted to leave her parents’ house during Iddah. In the case of Talaq Baa’in (irrevocable divorce) she must also abstain from beautifying herself, applying perfume, wearing makeup, wearing fancy clothes/jewellery, etc. [5]
In summary, due to dire necessity, the wife can move in with her parents after the husband’s lease ends if he refuses to renew it. [4] At her parents’ house, she will observe all the rules pertaining to Iddah, such as always remaining indoors and abstaining from beautifying herself (if the divorce is irrevocable).
