Question:
In the situation where a person (who has made niyyah of Tamattu’) in the months of Hajj went to Makkah first and performed Umrah then went to Madinah Munawwarah, according to Imam Sahab’s view will he be allowed to do Umrah again when returning to Makkah?
Or must he remain in the ihram for Hajj?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
If a person performs Umrah in the months of Hajj with the intention of Tamattu, that Umrah is complete once they come out of ihram.
If they then travel to Madinah and later return to Makkah, they must enter ihram again from the Miqat.
If they perform another Umrah after returning, it changes the original structure of Tamattu according to Hanafi Fiqh, because Tamattu is based on doing one Umrah followed by Hajj in the same season without inserting another Umrah in between. [1]
Because of this, the better and more appropriate option is to return in ihram with the intention of Hajj and proceed directly with it, rather than doing another Umrah.
