Question:
Assalamu Alaykum,
Would this business be Halal?
I draw maps of real-world places. I own the design, as these are my own drawings that I made myself. I upload them to my online store, where they are displayed as my products. Customers can see the design, choose the size of the print/canvas, see the price…
When a customer buys, they pay me first. Then the order is sent to Printify (a printing company), which I pay after having been paid by the customer who is made aware that I am not the manufacturer. Printify prints the item and ships it to the customer.
The fact that I am neither the printer nor the shipper is clearly stated on my website. I state that the products are my designs, and that the printing and shipping are done by Printify, and this is clearly disclosed.
Would this business be considered a valid bay‘ al-salam, istisna‘, or parallel istisna‘?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
Thank you for your question. May Allah ﷻ place barakah in your earnings and grant you clarity and integrity in your business dealings.
The business model you have described is permissible, provided it is structured correctly. From your explanation, it is not strictly a classical bay‘ al-salam, rather it is closest to istisna‘ in nature, combined with an element of wakalah (agency).
Istisna‘ is defined by the jurists as requesting a craftsman to produce a specific item according to agreed specifications [4]. In your case, the customer orders a product that does not yet exist and is produced after the order, which aligns with the nature of istisna‘. The permissibility of such transactions is recognised due to need and common practice [2].
For such a contract to be valid, the item must be clearly specified in all relevant aspects such as size, material, and type, so that no uncertainty remains. Transactions involving non-present goods are valid when their attributes are precisely defined, otherwise they fall into prohibited uncertainty [6].
Your use of a third party for printing and delivery falls under wakalah, which is the appointment of another to act on one’s behalf in a defined transaction [3]. This is permissible in commercial dealings, as the shariah allows delegation in trade activities where buying and selling is ongoing [7].
However, an important condition must be observed. The seller must bear responsibility for the product. A sale requires ownership or the ability to deliver, and that profit is only justified when liability is undertaken. Selling without bearing risk leads to the prohibition of profiting from what one has not guaranteed [5]. Therefore, you must remain fully responsible to the customer for delivery, defects, or loss. The contract is with you, not the printing company.
As for bay‘ al-salam, it is a specific contract where full payment is made in advance for a deferred item, and it carries its own distinct conditions [1]. Your model does not strictly fall under bay al-salam, as it is not structured according to its formal requirements.
In summary, your business is best understood as a modern istisna‘-based transaction with outsourced fulfilment (wakalah). It is permissible so long as the product is clearly specified, the process is transparent, and you retain full responsibility for the outcome.
Only Allah ﷻ knows best.
