Fatwa ID: 02015
Answered by Ustadha Mahdiyah Siddique
In this fatwa:
You said boiler cover is acceptable because:
"A breakdown cover is different from insurance in that one pays for the service, which the company offers him, which is to assist him at any time. The company does not pay any damages towards it. If one does not use their service during the course of the year, then payment still remains as one is paying for the service of them being there for you at any time."
British Gas the company I work would pay for the damages. For example if the valve on the boiler, or a part on the radiator stopped working then British Gas would pay for the part (assuming you have that level of cover), and then replace it with no labour costs either.
Bearing this in mind is it still halal to take out Boiler cover. If I mis-understood what you meant then, I do apologies. Please elaborate, and clarify.
In response to your question;
Breakdown cover has been rendered permissible for their service present continually; the involvement of parts being purchased by the company then is another issue and would be considered impermissible as this then turns into a form of insurance.
As mentioned in the above cited fatwa, the three conditions;
(1) Interest/ usury
(2) Element of deception
(3) Element of gambling/ chancing, upon which insurance(s) are considered impermissible would be found and present in the type of cover where the company would take it upon themselves to supply the part(s) required.
