Question:
Assalaamualaikum hope you are well
There’s a mother who is 18 weeks pregnant with twins. 1 twin is undersized and has a brain deficiency and is basically drawing blood from the other twin. Dr has advised that in order to save 1 twin the other needs to be removed. Please advise the sharia law regarding this

Answer:
Our perfect Deen strongly emphasises and prioritises the sanctity and preservation of life. [3]
Thus, abortion prior to 120 days of gestation (prior to the soul entering the body of the fetus) is highly sinful and impermissible, except in dire circumstances (e.g. severe fetal abnormality, pregnancy due to rape, etc.) [1, 2]
After 120 days of gestation, the fetus’s soul enters its body, and it is considered a human. Thus, at 18 weeks, it is absolutely impermissible to abort such a fetus, even in the case of fetal abnormality, rape, etc. Aborting such a fetus is tantamount to murder; thus, the mother may not terminate the pregnancy for any reason whatsoever. However, in your rare scenario, abortion of one twin will be permissible if certain strict conditions are met:
- The defective twin is likely to die, either in the womb or soon after birth; OR, the defective twin will be born severely malformed and physically and mentally incapacitated
- AND the defective twin is actively causing the death of the healthy twin,
- AND removing the defective twin will very likely save the life of the other twin. [4]
If these conditions are fulfilled and a pious Muslim doctor confirms that aborting one twin is the best option as a last resort in your scenario, if will be permissible to do so based on removing a greater harm (possible death of both twins) by committing an act of lesser harm (aborting one twin who is highly unlikely to survive to save the other healthy twin’s life). [6]
On the other hand, if, for example, the defective twin will likely survive in the womb, or the other twin’s life is not at dire risk, it will be completely Haram to abort the defective twin. i.e. If the strict conditions above are not met, abortion of the defective twin will be impermissible.
May Allah Ta’ala make matters easy for the family concerned.

وَنُقِلَ عَنْ الذَّخِيرَةِ لَوْأَرَادَتْ الْإِلْقَاءَ قَبْلَ مُضِيِّ زَمَنٍ يُنْفَخُ فِيهِ الرُّوحُ هَلْ يُبَاحُ لَهَا ذَلِكَ أَمْ لَا؟ اخْتَلَفُوا فِيهِ، وَكَانَ الْفَقِيهُ عَلِيُّ بْنُ مُوسَى يَقُولُ:
