Question:
Did any of the 4 Imams hold the position that Zakaat can be given to non Muslims?

Answer:
Thank you for your question. We ask Allah ﷻ to grant us correct understanding of His rulings and sincerity in fulfilling His obligations.
Allah ﷻ says:
۞ إِنَّمَا ٱلصَّدَقَـٰتُ لِلْفُقَرَآءِ وَٱلْمَسَـٰكِينِ وَٱلْعَـٰمِلِينَ عَلَيْهَا وَٱلْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِى ٱلرِّقَابِ وَٱلْغَـٰرِمِينَ وَفِى سَبِيلِ ٱللَّهِ وَٱبْنِ ٱلسَّبِيلِ ۖ فَرِيضَةًۭ مِّنَ ٱللَّهِ ۗ وَٱللَّهُ عَلِيمٌ حَكِيمٌۭ
“The Sadaqāt (prescribed alms) are (meant) only to be given to the poor, the needy, to those employed to collect them, to those whose hearts are to be won, in the cause of the slaves and those encumbered with debt, in the way of Allah and to a wayfarer. This is an obligation prescribed by Allah. Allah is All-Knowing, Wise.”
(Surah al Tawbah 9:60)
This noble verse restricts Zakat to eight specific categories. The word “Innama” indicates exclusivity, meaning Zakat is confined to those listed. The jurists understood these categories to refer to Muslim recipients within the believing community.
The Prophet Muhammad ﷺ said when sending Muadh صلى الله عليه وسلم to Yemen:
إن الله قد افترض عليهم صدقة في أموالهم تؤخذ من أغنيائهم فترد في فقرائهم
“Allah has made it obligatory upon them to give charity from their wealth. It is taken from their wealthy and returned to their poor.” (Mishkat al-Masabih 1772)
The phrase “their wealthy” and “their poor” was understood to refer to the Muslim community, showing that Zakat circulates within the believers.
Position of the Four Schools:
Hanafiyyah:
- Zakat is not valid if given to a non Muslim
- Abu Hanifah رحمه الله held that it does not discharge the obligation
- The hadith of Muadh رضي الله عنه is relied upon
Malikiyyah:
- Zakat cannot be given to a non Muslim
- The categories in Surah al Tawbah are restricted to Muslims
Shafiiyyah:
- It is not permissible to give Zakat al mal or Zakat al Fitr to a non Muslim
- Scholars mention consensus that Zakat of wealth is not valid if given to a non Muslim
Hanabilah:
- Zakat is not valid if given to a non Muslim
- They rely on the hadith of Muadh رضي الله عنه
- The only historical discussion concerned those whose hearts were to be reconciled
None of the four Imams permitted general Zakat to be given to non Muslims. The obligation is fulfilled only when given to eligible Muslim recipients as defined in Surah al Tawbah. Voluntary charity may be given to non Muslims and this is encouraged.

عَنِ اِبْنِ عَبَّاسٍ رَضِيَ اَللَّهُ عَنْهُمَا: { أَنَّ اَلنَّبِيَّ - صلى الله عليه وسلم -بَعَثَ مُعَاذًا - رضى الله عنه - إِلَى اَلْيَمَنِ... } فَذَكَرَ اَلْحَدِيثَ, وَفِيهِ: { أَنَّ اَللَّهَ قَدِ اِفْتَرَضَ عَلَيْهِمْ صَدَقَةً فِي أَمْوَالِهِمْ, تُؤْخَذُ مِنْ أَغْنِيَائِهِمْ, فَتُرَدُّ فِ ي 1 فُقَرَائِهِمْ } مُتَّفَقٌ عَلَيْهِ, وَاللَّفْظُ لِلْبُخَارِيّ ِ 2 .

Ahnaaf:
ولا يجوز أن تدفع الزكاة إلى ذمي، لقوله – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – لمعاذ – رَضِيَ اللَّهُ عَنْهُ – «خذها من أغنيائهم وردها في فقرائهم» . قال: ويدفع إليه ما سوى ذلك من الصدقة. وقال الشافعي – رَحِمَهُ اللَّهُ – لا يدفع وهو رواية عن أبي يوسف – رَحِمَهُ اللَّهُ

وذكر أبو يوسف في الإملاء عن أبي حنيفة: أنه لا يجوز؛ لأن الكفر مما يحكم به، وما كان محكومًا به، فهو كالمقطوع به

Malikiyya:
فلا يجوز له دفع ذلك إليهم، كما لا يجوز دفع الزكاة إليهم

Shawafi:
قَالَ الْمُصَنِّفُ رَحِمَهُ اللَّهُ
* (ولا يجوز دفعها إلى كافر لقوله صلي الله عليه وسلم ” أمرت أن آخذ الصدقة من اغنيائكم وأردها علي فقرائكم “)
* (الشرح) هذا الحديث رواه البخار وَمُسْلِمٌ مِنْ رِوَايَةِ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لِمُعَاذٍ رَضِيَ اللَّهُ عَنْهُ ” أَعْلِمْهُمْ أَنَّ عَلَيْهِمْ صَدَقَةً تُؤْخَذُ مِنْ أَغْنِيَائِهِمْ وَتُرَدُّ فِي فُقَرَائِهِمْ ” وَسَبَقَ بَيَانُهُ فِي فَصْلِ نَقْلِ الزَّكَاةِ وغيره ولايجوز دفع شئ مِنْ الزَّكَوَاتِ إلَى كَافِرٍ سَوَاءٌ زَكَاةُ الْفِطْرِ وَزَكَاةُ الْمَالِ وَهَذَا لَا خِلَافَ فِيهِ عِنْدَنَا قَالَ ابْنُ الْمُنْذِرِ: أَجْمَعَتْ الْأُمَّةُ أَنَّهُ لَا يُجْزِئُ دَفْعُ زَكَاةِ الْمَالِ إلَى الذِّمِّيِّ

Hanabila:
[ولا يجزئ دفع الزكاة للكافر] غير المؤلف، لحديث معاذ “تؤخذ من أغنيائهم، فترد إلى فقرائهم” وقال ابن المنذر: أجمعوا على أن الذمي لا يعطى من الزكاة
