Do We Add On the Debts Which People Owe to Our Annual Calculation of the Nisaab

Question

 

I have found in a booklet that if a person does not receive money that he has given as debts to others, during the days of Qurbani, then that amount will not be added with his wealth to calculate nisab amount. It is true?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

Qurbani will become Wajib on a person when he/she has in their possession the amount of the nisab during the days of Qurbani. (Fatawa Mahmoodiyyah, Volume 17, Page 309, Darul Iftaa Jamiah Farooqiyyah)

 

Loaning money to a second party is inevitably handing over the ownership to them to use as they see right. (Qamusul Fiqhi, Volume 2, Page 446-447, Zamzam Publishers)

 

Keeping the above in mind, if the person does not receive the amount being owed to him during the days of Qurbani, it will not be added with the rest of the wealth.
