Question:
If the husband says ‘kasam khao, shaadi ki baat hai and if you are lying the marriage would have been…” the wife took a false oath as it was about her previous sin hence to save marriage
The husband later said that intention was not immediate divorce but no point in keeping such a marriage
Does the divorce happen according to Hanafi fiqh?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
The rulings of divorce are based upon exact statements.[1] Considering that you do not appear to have quoted the husband’s statement in full, it is not possible to issue a verdict upon incomplete information.
Statements of divorce are also highly dependent on language and culture.[2] You should consult a qualified scholar from your local area regarding the exact words you used, especially if you were not communicating in standard English but rather a mix of two languages.
Keep in mind that false oaths are an extremely serious matter. The Prophet (ﷺ) said, “The biggest sins are: to join others in worship with Allah; to be undutiful to one’s parents; to kill somebody unlawfully; and to take an immersing [ie: false] oath.[3] The wife should repent sincerely from her false oath and make a sincere intention never to repeat such a grave sin.[4]
Also note that in the case wherein your intention is the deciding factor, the husband must be honest regarding his intention during this argument. This is a matter of personal responsibility, and it is necessary for him to be completely honest regardless of the outcome. Allah’s Messenger (ﷺ) said: “It is obligatory for you to tell the truth, for truth leads to virtue and virtue leads to Paradise, and the man who continues to speak the truth and endeavours to tell the truth is eventually recorded as truthful with Allah, and beware of telling of a lie for telling of a lie leads to obscenity and obscenity leads to Hell-Fire, and the person who keeps telling lies and endeavours to tell a lie is recorded as a liar with Allah.” [Sahih Muslim 2607c] [5]
Only Allah ﷻ knows best.
