Question:

If the husband says to wife “ if you are lying, we will talk about it and then end marriage” and the wife is lying, does that end marriage immediately according to Hanafi fiqh?

The husband will divorce though after speaking to the wife, once he finds out that the wife if lying

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Divorce will not automatically occur with this statement.

A statement such as “if you are lying, we will talk about it and then end marriage” appears to be a threat of issuing a divorce in the future, and so no divorce will occur with this statement. It is not a conditional statement, as the divorce is not attached to the condition of lying.[1] Therefore, no divorce will occur automatically.

Note that statements of divorce are highly dependent on language and culture.[2] You should consult a qualified scholar from your local area regarding the exact words you used, especially if you were not communicating in standard English.
