Question:
Assalamu alaikum, can you clarify the answer to this question please:
https://daruliftabirmingham.co.uk/home/researching-talaq-questions-on-the-internet/
In the linked QA, the person posing the question said he has entered explict statements in google to bring up search results. The answer makes references to single words, as opposed to the statements. Therefore, can you confirm what the conclusive answer is?
Wassalam

Answer:
Divorce will not occur through normal use of Google without the intention to divorce.
Search queries such as “I divorced my wife” or “I divorced my wife in anger” as mentioned in the question being referred to do not cause divorces to occur without intention. This is because such phrases are describing a past event and so would count as a confession or false confession, and such confessions do not cause divorces to be issued without intention.[1]
In general, normal search queries would not constitute written divorces as they are usually not clearly addressed in an appropriate manner to a person’s wife specifically as is required for written divorces.[2] Search queries are also usually implicitly questions as per the medium, and so can be compared to asking about an incident of divorce or quoting possible divorce phrases in the books of fiqh, which do not usually cause divorce to occur outside of intention.[2]
Note that in cases wherein your intention is the deciding factor, you must be honest regarding his intention during this argument. This is a matter of personal responsibility, and it is necessary for you to be completely honest regardless of the outcome. Allah’s Messenger (ﷺ) said: “It is obligatory for you to tell the truth, for truth leads to virtue and virtue leads to Paradise, and the man who continues to speak the truth and endeavours to tell the truth is eventually recorded as truthful with Allah, and beware of telling of a lie for telling of a lie leads to obscenity and obscenity leads to Hell-Fire, and the person who keeps telling lies and endeavours to tell a lie is recorded as a liar with Allah.” [Sahih Muslim 2607c] [3]
Only Allah ﷻ knows best.
