Question:
Assalamu Alaikum Wa Rahmatullah
السلام علیکم و رحمۃاللہ و برکاتہ
مفتی صاحب کیبارگاہمیں عرض ہےکہ درج ذیلتینسوالاتکےحوالےسے مدلل و مفصل تحریریفتویدرکارہے۔
[1] میںآسڑیلیامیںرہتاہوں، یہاںایک مسلمان گوشت فروش ہے۔ وہسلاٹرہاوسمیںجاکربکرے اور گائےہاتھسےچھریپکڑکرتکبیرپڑھکر ذبح کرتاہے۔ سلاٹرہاوسکفار{ غیرکتابیوں} کیملکیتہے۔ جو جانوروہ مسلمان ذابح نے ذبح کیےہوتےہیں، ان کوکھال اتار کرنمبرالاٹکرکےسلاٹرہاوسمیں سرد خانےمیںرکھدیاجاتاہے۔ پھر 24 گھنٹے بعد مسلمان گوشت فروش وہ سالم ذبح شدہجانوروہاںسےخریدکرلاتےہیں اور مسلمانوںکوبیچتےہیں۔ مسلمان قصابوںکے بقول ان کے ذبح شدہجانور {جن پرنمبرالاٹکیےجاتےہیں }وہکفارکے ذبح کیےہوئےجانوروںکےساتھتبدیلہوجائیںایسانہیںہوتا، سرد خانےوغیرہپرمامورتماممزدوربھیغیرمسلم {غیرکتابی} ہوتےہیں اور ان کاکہناہےکہیہوہیجانورہیںجنہیں مسلمان ذابح نے ذبح کیاہے۔ شرعیرہنمائیفرمائیں: {1} کیامذکورہ بالا جانور جن پرنمبرالاٹکیےجاتےہیں مسلمان گوشتفروشوںکویہخریدنا جائز ہے؟ {2} ان گوشتفروشوںکایہگوشت عام مسلمانوںکوبیچناکیساہے؟
[2] یہاںآسڑیلیامیںبڑےجانور مثلا گائےکو ذبح کرنےسےپہلے اس کے سر پرایکبجلیکینوک دار گنسےکرنٹدیاجاتاہے ، کچھلوگزوردار خاص آلات سےمارتےہیں اور کچھلوگ اس کے سر میںگنسےبولٹشوٹکرتےہیں ۔ اس پروسیسکوسٹننگکہتےہیں۔اسسےجانوربظاہرزندہہیہوتاہےلیکن اس کا دماغ ختم ہوجاتاہےیاکچھدرجہ مفلوج ہوجاتاہے۔لیکنظاہری طور پر جان نظر آتیہےجیسےہلناوغیرہ۔ تو اس طرح ذبح کیےگئےجانورکاگوشتخریدنا اورکھاناکیساہے؟ اگرجانورکو اس طرح سےچوٹدیجائےکہاگراسے ذبح نہکیاگیا تو خود بخود مر جائےگا تو اس طرح کیچوٹدینےکے بعد مرنےسےپہلےپہلے ذبح کیےگئےجانورکاحکمبھیبیان فرما دیجئے۔
[3] یہاںآسٹریلیامیں مارکیٹمیں چکن دو طرح کا ملتا ہےکچھکےپاسہاتھسے ذبح شدہہوتاہے اور کچھمشینسے ذبح شدہچکنفروختکرتےہیں۔ مشینسے ذبح شدہچکنکاحکمبیان فرما دیجئے اور یہبھی کہاگرہمکسی مسلمان کےہاں دعوت پرگئے تو کیایہپوچھنا لازم ہےکہوہیہتحقیقکرکےلایاہےکہیہہاتھسے ذبح شدہہے؟اوراگر اس کو معلوم نہہوکہہاتھسے ذبح شدہہےیامشینسے۔ تو پھر اس کاکیاحکمہوگا؟ پہلےکے دو سوالاتمیںکسی مسلمان کےمہمانہونےکی صورت میںگوشتکھانےکےحوالےسےشرعیاحکامبیان فرما دیجئے

Answer:
بسم الله الرحمن الرحيم
In the name of Allah, the Most Gracious, the Most Merciful.
- a. It will be permissible to buy and consume the animal as long as it has been slaughtered according to the conditions of slaughtering, that the animals slaughtered Islamically and non-Islamically are clearly distinguishable so they do not get mixed up, and that the utensils used for the slaughtering process are not used for the non-Islamically slaughtered animals.
b. It will also be permissible to sell the meat that has been slaughtered this way.
- Stunning an animal before slaughtering it will be halal, as long as all the conditions of slaughtering are met, and it is confirmed that the animal itself was not killed due to the stunning and in fact was slaughtered Islamically. If an animal were to die from the power of the stun then it will be haram to consume the animal in this case.
Many scholars have said that it does cause the animal undue pain before the slaughtering and have said to do so unnecessarily would be considered makruh.[1]
- Chicken slaughtered through a machine will not be considered halal according to the Hanafi madhab, it must be hand-slaughtered.
If someone has invited you to their home for food and you are aware of the person’s piety and uprightness that he will not feed anyone anything haram, it will be permissible to consume that meat.
If, however, you know that this person does not care about whether the food he is serving is halal or not then a person should not eat from that food.
Only Allah SWT alone knows best.
