Question:

 

  1. Looking at a mahram with lust
  2. Touching a mahram with lust
  3. Kissing a mahram with lust
  4. Having sex with a mahram
  5. Wanting nikaah with a mahram

Are all Haraam?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

It is Haram to have sexual intercourse with a Mahram.

 

It is Haram for a man or woman to marry their Mahram relatives (Raddul Mukhtar, Vol 4, Pg 100).

 

Anything which leads to a Haram act (kissing, touching, etc would likely lead to sexual relations) would also be considered haram (Maqasid Shariah, Pg 9).

 

Regarding wanting a Nikah (as opposed to getting a Nikah done), one should not act on it in any way.

 

Ibn Abbas (Ra) narrated: The Prophet ﷺ narrating about his Lord said, “Allah ordered (the appointed angels over you) that the good and the bad deeds be written, and He then showed (the way) how (to write). If somebody intends to do a good deed and he does not do it, then Allah will write for him a full good deed (in his account with Him); and if he intends to do a good deed and actually did it, then Allah will write for him (in his account) with Him (its reward equal) from ten to seven hundred times to many more times: and if somebody intended to do a bad deed and he does not do it, then Allah will write a full good deed (in his account) with Him, and if he intended to do it (a bad deed) and actually did it, then Allah will write one bad deed (in his account).” (Sahih Al Bukhari, 6491)

 

Similarly, Abu Hurairah (Ra) narrated: The Prophet said, “Allah has forgiven my followers the evil thoughts that occur to their minds, as long as such thoughts are not put into action or uttered.” (Sahih Al Bukhari, 5269)

 

Therefore, looking at, touching, or kissing a Mahram with lust, and having sexual intercourse with or marrying a Mahram are all Haram.

 

 

عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ مَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ فَاقْتُلُوهُ وَمَنْ وَقَعَ عَلَى بَهِيمَةٍ فَاقْتُلُوهُ وَاقْتُلُوا الْبَهِيمَةَ

الرجل كما يحرم عليه التزوج أصله أو فرعه  كذلك يحرم علي المرأة تزوج أصلها أو فرعها

و ما أدي إلي الممنوع فهو ممنوع

عَنِ ابْنِ عَبَّاسٍ رضى الله عنهما عَنِ النَّبِيِّ صلى الله عليه وسلم فِيمَا يَرْوِي عَنْ رَبِّهِ عَزَّ وَجَلَّ قَالَ قَالَ  إِنَّ اللَّهَ كَتَبَ الْحَسَنَاتِ وَالسَّيِّئَاتِ، ثُمَّ بَيَّنَ ذَلِكَ فَمَنْ هَمَّ بِحَسَنَةٍ فَلَمْ يَعْمَلْهَا كَتَبَهَا اللَّهُ لَهُ عِنْدَهُ حَسَنَةً كَامِلَةً، فَإِنْ هُوَ هَمَّ بِهَا فَعَمِلَهَا كَتَبَهَا اللَّهُ لَهُ عِنْدَهُ عَشْرَ حَسَنَاتٍ إِلَى سَبْعِمِائَةِ ضِعْفٍ إِلَى أَضْعَافٍ كَثِيرَةٍ، وَمَنْ هَمَّ بِسَيِّئَةٍ فَلَمْ يَعْمَلْهَا كَتَبَهَا اللَّهُ لَهُ عِنْدَهُ حَسَنَةً كَامِلَةً، فَإِنْ هُوَ هَمَّ بِهَا فَعَمِلَهَا كَتَبَهَا اللَّهُ لَهُ سَيِّئَةً وَاحِدَةً

عَنْ أَبِي هُرَيْرَةَ رضى الله عنه عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ‏ إِنَّ اللَّهَ تَجَاوَزَ عَنْ أُمَّتِي مَا حَدَّثَتْ بِهِ أَنْفُسَهَا، مَا لَمْ تَعْمَلْ أَوْ تَتَكَلَّمْ
