Using Phones for Halal and Haram Reasons

Question:

 

I would like to know what is the hukm of the following. I know you wanted a question but all questions are about the same topic (using something that was used/is used in a haram way in halal activities or similar). If I am wrong with the interpretation of the submitting one question, kindly answer to a point only chosen by you.

 

* I have bought AirPods and have the problem that if I start them a woman is beginning to talk with a voice maybe melodious and musical sounds also occur at the beginning and it is the same if I close the AirPods. When I wait before I take them into my ears I don’t hear them. What is the hukm of using these AirPods for everything (halal) like listening to the Qur’an and religious speeches etc? It was not my intention of mine to buy AirPods with such sounds. Should I buy new AirPods?

 

*Hukm of using a mobile phone which was often used in haram ways like pornography, watching films, cartoons, etc. to read the Quran, Hadith, messaging Ayahs etc. after making tawba or not tawba. Should this person buy a new mobile phone?

 

 

*In Fatawaa Hindiya there is a sentence similar/corresponding to (I am not sure) “Who says something bad after reciting the Qur’an (or reverse) has committed kufr since this is like throwing the Qur’an to the dirt” How should I understand this?

Answer:

 

Most, if not all, AirPods have some form of audio confirmation when they are connected. Looking for new AirPods without that function would cause unnecessary difficulty (Qawaaid Fiqhiyyah, Pg 40). (1) Therefore, you do need to buy new AirPods.

 

As for the phone, it would be Haraam to use it for Haraam things. If you do not do Haraam things on it, it will not be prohibited to use, as the cause for the prohibition is no longer present (Qawaaid Fiqhiyyah, Pg 76). (2) Therefore, you would not be required to purchase a new phone. You should simply refrain from using it for Haraam.

 

I did not find any mention, in Fatawa Hindiyya, of saying something bad before or after reciting the Qur’an is equivalent to Kufr. You should recite the Qur’an in the best state possible (Fatawa Hindiyya, Vol 5, Pg 390). (3) You would be sinful for reciting the Qur’an in a setting where sin is openly being committed and the Qur’an would be mocked and slandered (Fatawa Hindiyya, Vol 5, Pg 389). (4)

الْكَلَامُ مِنْهُ مَا يُوجِبُ أَجْرًا كَالتَّسْبِيحِ وَالتَّحْمِيدِ وَقِرَاءَةِ الْقُرْآنِ وَالْأَحَادِيثِ النَّبَوِيَّةِ وَعِلْمِ الْفِقْهِ، وَقَدْ يَأْثَمُ بِهِ إذَا فَعَلَهُ فِي مَجْلِسِ الْفِسْقِ وَهُوَ يَعْلَمُهُ لِمَا فِيهِ مِنْ الِاسْتِهْزَاءِ وَالْمُخَالَفَةِ لِمُوجِبِهِ، وَإِنْ سَبَّحَ فِيهِ لِلِاعْتِبَارِ وَالْإِنْكَارِ وَلِيَشْتَغِلُوا عَمَّا هُمْ فِيهِ مِنْ الْفِسْقِ فَحَسَنٌ
