Question:

 

The Assistant Commissioner of Excise in Civil Services is responsible for the collection of excise duty on alcoholic beverages and taking preventative measures against illicit sources of drugs through regulatory and enforcement 9actions ¹.

 

The Assistant Commissioner of Excise is tasked with ensuring that Foreign Liquor manufacturers and Bottling Plants receive the necessary permits and licenses to operate legally ². Additionally, they are responsible for conducting inspections and raids to prevent tax evasion and illegal activities in the excise sector ³.

 

Is the above-mentioned job profile permissible in Islam?

Answer:

 

Any job that constitutes direct involvement in manufacturing and promoting the sales of alcohol will not be permissible. The Messenger of Allah (peace and blessings upon him) warned about the curse of Allah coming upon those who are involved in manufacturing and promoting alcohol.

 

However, if the job does not entail direct involvement in the manufacturing and promoting of alcohol but if it is indirect like working for an electrical company that has a contract to do work for an alcohol manufacturing company, it will be permissible to do that job.

 

Narrated Abdullah ibn Umar:

 

The Prophet (peace be upon him) said: Allah has cursed wine, its drinker, its server, its seller, its buyer, its presser, the one for whom it is pressed, the one who conveys it, and the one to whom it is conveyed.

 

The job description mentioned in the question will not be permissible since it entails direct involvement in the manufacturing of alcohol and promoting its sale.

«(وَ) جَازَ (بَيْعُ عَصِيرِ) عِنَبٍ (مِمَّنْ) يُعْلَمُ أَنَّهُ (يَتَّخِذُهُ خَمْرًا) لِأَنَّ الْمَعْصِيَةَ لَا تَقُومُ بِعَيْنِهِ بَلْ بَعْدَ تَغَيُّرِهِ وَقِيلَ يُكْرَهُ لِإِعَانَتِهِ عَلَى الْمَعْصِيَةِ وَنَقَلَ الْمُصَنِّفُ عَنْ السِّرَاجِ وَالْمُشْكِلَاتِ أَنَّ قَوْلَهُ مِمَّنْ أَيْ مِنْ كَافِرٍ أَمَّا بَيْعُهُ مِنْ الْمُسْلِمِ فَيُكْرَهُ وَمِثْلُهُ فِي الْجَوْهَرَةِ وَالْبَاقَانِيِّ وَغَيْرِهِمَا زَادَ الْقُهُسْتَانِيُّ مَعْزِيًّا لِلْخَانِيَّةِ أَنَّهُ يُكْرَهُ بِالِاتِّفَاقِ»

 

سنن أبي داود (3 / 326):

“قال رسول الله صلى الله عليه وسلم: «لعن الله الخمر، وشاربها، وساقيها، وبائعها، ومبتاعها، وعاصرها، ومعتصرها، وحاملها، والمحمولة إليه»”.

«قَوْلُهُ مِمَّنْ يَعْلَمُ) فِيهِ إشَارَةٌ إلَى أَنَّهُ لَوْ لَمْ يَعْلَمْ لَمْ يُكْرَهْ بِلَا خِلَافٍ قُهُسْتَانِيٌّ (قَوْلُهُ لَا تَقُومُ بِعَيْنِهِ إلَخْ) يُؤْخَذُ مِنْهُ أَنَّ الْمُرَادَ بِمَا لَا تَقُومُ الْمَعْصِيَةُ بِعَيْنِهِ مَا يَحْدُثُ لَهُ بَعْدَ الْبَيْعِ وَصْفٌ آخَرُ يَكُونُ فِيهِ قِيَامُ الْمَعْصِيَةِ وَأَنَّ مَا تَقُومُ الْمَعْصِيَةُ بِعَيْنِهِ مَا تُوجَدُ فِيهِ عَلَى وَصْفِهِ الْمَوْجُودِ حَالَةَ الْبَيْعِ كَالْأَمْرَدِ وَالسِّلَاحِ وَيَأْتِي تَمَامُ الْكَلَامِ عَلَيْهِ (قَوْلُهُ أَمَّا بَيْعُهُ مِنْ الْمُسْلِمِ فَيُكْرَهُ) لِأَنَّهُ إعَانَةٌ عَلَى الْمَعْصِيَةِ قُهُسْتَانِيٌّ عَنْ الْجَوَاهِرِ»
