Ruling On Intentionally Committing A Jinayah To Exit Ihram

Question: 

 

السلام عليكم ورحمة الله وبركاته

 

Did anybody read and have the hawalah for the mas’ala that if a person in ihraam does any jinayat with the intention of coming out if ihraam, he will be regarded as out of ihraam and will only have to pay 1 damm for the jinayat which he used to take him out of ihraam?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

A person in Ihram who attempts to exit Ihram by committing a Jinayah must pay one Dam [1]. Below are references from Raddul Muhtar and Bahrur Raa’iq supporting this claim [2].
