The Ruling On Making Du’a In A Language Other Than Arabic During Salah And Changing The Method Of Witr By Following Opinions Of Other Madhabs

Question:

 

The following text has been translated into English:

 

  1. Assalamu Alaikum! Regarding making du’a in one’s native language during the prostrations in the sunnah, mandub, and nafl prayers, what was the opinion of Ibn Humam, as well as the commentator of “Sahih Al Bukhari,” Badruddin Al Ayni?

 

  1. Ibn Humam asserted that a muqallid can contradict his madhab and take an easier fatwa from another madhab, provided that it is not a weak opinion and does not involve talfiq. Based on his words, for example, is it permissible to pray Witr as three rak’ahs with one tashahhud at the end?

Answer:

 

You have attempted to ask multiple questions seeking to edit the method in which Salah is performed from the agreed upon Hanafi opinion using niche opinions of the past. However, the response shall remain the same regardless of how many times such questions are asked. All answers will be given according to the consensus of Hanafi scholars as derived from a qualified and thorough analysis of the opinions of past scholars and their evidence.

 

It is not permissible to make Du’a in one’s native language during Salah. Dua’s must be made in Arabic as per the Sunnah [1].

 

It is not permissible to switch between different Madhabs and opinions to follow one’s whims and desires [2]. Witr is performed as three Rakah with two Tashahhuds, one in the second Rak’ah and another at the end [3].

 

As for those who seek to circumvent the consensus of modern Hanafi scholars by seeking out obscure opinions from the works of early Hanafi scholars, know that it is through the thorough and qualified study of the opinions of early Hanafi scholars and their sources that the opinions of modern scholars are derived. As narrated from the Prophet ﷺ:

 

حَدَّثَنَا أَبُو بَكْرِ بْنُ نَافِعٍ الْبَصْرِيُّ، حَدَّثَنِي الْمُعْتَمِرُ بْنُ سُلَيْمَانَ، حَدَّثَنَا سُلَيْمَانُ الْمَدَنِيُّ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ “‏ إِنَّ اللَّهَ لاَ يَجْمَعُ أُمَّتِي – أَوْ قَالَ أُمَّةَ مُحَمَّدٍ صلى الله عليه وسلم – عَلَى ضَلاَلَةٍ وَيَدُ اللَّهِ مَعَ الْجَمَاعَةِ وَمَنْ شَذَّ شَذَّ إِلَى النَّارِ ‏”‏

Narrated Ibn Umar ﵁: The Messenger of Allah ﷺ said: “Indeed, Allah will not gather my Ummah (or he said the Ummah of Muhammad ﷺ) upon misguidance. The hand of Allah is with the Jama’ah, and whoever deviates will deviate to the hellfire.” (Jami’ At-Tirmidhi 2167)

 وَمَن يُشَاقِقِ الرَّسُولَ مِن بَعْدِ مَا تَبَيَّنَ لَهُ الْهُدَىٰ وَيَتَّبِعْ غَيْرَ سَبِيلِ الْمُؤْمِنِينَ نُوَلِّهِ مَا تَوَلَّىٰ وَنُصْلِهِ جَهَنَّمَ ۖ وَسَاءَتْ مَصِيرًا 

Surah An-Nisa’ 115

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، حَدَّثَنَا أَبُو خَالِدٍ، – يَعْنِي الأَحْمَرَ – عَنْ حُسَيْنٍ الْمُعَلِّمِ، ح قَالَ وَحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، – وَاللَّفْظُ لَهُ – قَالَ أَخْبَرَنَا عِيسَى بْنُ يُونُسَ، حَدَّثَنَا حُسَيْنٌ الْمُعَلِّمُ، عَنْ بُدَيْلِ بْنِ مَيْسَرَةَ، عَنْ أَبِي الْجَوْزَاءِ، عَنْ عَائِشَةَ، قَالَتْ كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَسْتَفْتِحُ الصَّلاَةَ بِالتَّكْبِيرِ وَالْقِرَاءَةَ بِـ ‏{‏ الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ‏}‏ وَكَانَ إِذَا رَكَعَ لَمْ يُشْخِصْ رَأْسَهُ وَلَمْ يُصَوِّبْهُ وَلِكَنْ بَيْنَ ذَلِكَ وَكَانَ إِذَا رَفَعَ رَأْسَهُ مِنَ الرُّكُوعِ لَمْ يَسْجُدْ حَتَّى يَسْتَوِيَ قَائِمًا وَكَانَ إِذَا رَفَعَ رَأْسَهُ مِنَ السَّجْدَةِ لَمْ يَسْجُدْ حَتَّى يَسْتَوِيَ جَالِسًا وَكَانَ يَقُولُ فِي كُلِّ رَكْعَتَيْنِ التَّحِيَّةَ وَكَانَ يَفْرِشُ رِجْلَهُ الْيُسْرَى وَيَنْصِبُ رِجْلَهُ الْيُمْنَى وَكَانَ يَنْهَى عَنْ عُقْبَةِ الشَّيْطَانِ وَيَنْهَى أَنْ يَفْتَرِشَ الرَّجُلُ ذِرَاعَيْهِ افْتِرَاشَ السَّبُعِ وَكَانَ يَخْتِمُ الصَّلاَةَ بِالتَّسْلِيمِ ‏.‏ وَفِي رِوَايَةِ ابْنِ نُمَيْرٍ عَنْ أَبِي خَالِدٍ وَكَانَ يَنْهَى عَنْ عَقِبِ الشَّيْطَانِ
