Question:
Asalamua’laykum Mufti Saab, InshAllah you’re well. I just had an urgent question.
There was a case where the husband during an argument, in the state of extreme anger said to his wife, I can’t do this, divorce, divorce, divorce (in Urdu). The husband also has some form of bipolar disorder and was not on any medication. It seemed as though he was having a manic episode as his mouth filled with spit and lost control of his emotions. They were in a stressful heated argument in the car, he kept losing control of the car. Is such a case a valid divorce?

Answer:
If a bipolar husband issues his wife talaq whilst suffering from a manic, hypomanic, or depressive episode then the talaq issued will not be deemed valid as such a person is deemed to be majnun and a majnun individual is excused.
Manic episodes involve high energy levels, racing thoughts, and impulsivity which severely affect one’s thinking and can impair one’s ability to focus, recall facts, and make decisions. Hence, the divorce of a bipolar husband who has lost rational control, volition, or awareness of their actions is deemed invalid.

وروى ابن أبي شيبة في ” مصنفه ” حدثنا حفص بن غياث عن حجاج عن عطاء عن ابن عباس قال: لا يجوز طلاق الصبي وفي ” شرح الطحاوي “، ولو أن الصبي والمجنون طلق امرأته لم يقع طلاقه، وكذا المغمى عليه ( … ) والمدهوش والنائم والمعتوه

ويقع طلاق كلّ زوْج إذا كان عاقلا بالغا ولا يقع طلاق الصبيّ والمجنون والنائم) لقوله “كُلُّ طَلَاقٍ جَائِزٌ إلَّا طَلَاقَ الصَّبِيِّ وَالْمَجْنُونِ” ولأنّ الْأهليّة بالعقل المميّز وهما عديما العقل
