The Ruling On Uttering Three Talaqs In One Sitting

Question:

 

Assalam o Alaikum!

I’m in dire need of guidance as my heart is not in peace and since yesterday I’ve done a lot of research to educate myself. My husband and I were having major arguments from couple of days, we tried to ignore eachother but when we talked we both got frustrated and started blaming eachother, I totally feel it’s my mistake that i kept on provoking him despite knowing his anger is bad and he says whatever comes to his mind but never uttered divorce. The fight got intense and I started saying give it to me multiple times, he ignored and didn’t uttered anything but since I was just getting on his nerves plus I’d like to mention he’s suffering from fever from 2,3 days and he lived alone. Our rukhsati hasn’t been done yet but we consummated after our nikkah that was a year ago, currently we’re in a long distance and it’s the reason why we’re having major fights.

 

So when we were having an intense fight and i ignited it because i was angry too he uttered (I XYZ give you talaq, talaq, talaq) in one sitting and one breath and after 5 minutes when we got into our senses we regret immediately as both parties were in anger and keeps on adding fuel to the fire and immediately did toba and want to stay together as we won’t be doing this ever in future and love eachother to the core and we promised eachother that we’ll never let this happen again because we know the consequences and if we stayed apart it’ll torture is mentally especially me when I’m already going through anxiety and episodic depression, I don’t see my life without him and so does he. Honestly we didn’t had knowledge about the process of giving talaq in islam, we both were (May Allah Forgive Us) used to think it happens by saying it thrice and which shocked us when it happened.

 

We checked online read surah’s checked firqah’s opinion. Now my husband says it counts as one (we don’t actually follow any firqah) In this case it considers as one or three? As muslims we want to follow the teachings of Hazrat Muhammad PBUH instead of anything else to have a clear set of mind and his intention was not to get separated it happened because we both are hot headed and i forced thinking it’s just an argument, some people say that people change their firqah just to help themselves. According to Quran there is no concept of giving 3 talaq at once and even if someone gives Talaq e bidah, it counts as one in Ahl e hadith and done and dusted in Ahl e sunnat.

 

We’re in dire need of the right guidance according to Quran & Prophet PBUH’s teachings. Please replay to this. As only I’m having a conflict of mind when I hear 3=3. Also islam encourages love and harmony and Islam makes our lives easier not hard. We never had this thought of going through this sinful thing again which Allah doesn’t like, we love eachother a lot and we 1000% want to be with eachother. I want to know how to calm myself down because in the back of my mind I’m worried that what if it’s a sin because of the four school of thoughts but at the same time can’t imagine my life without my husband. We’re in peace now as we’ve made promise to not fight again and will try more to create harmony between us.

Answer:

 

You are fully and irrevocably divorced.

 

According to the Hanafi madhhab, the words “I [XYZ] give you talaq, talaq, talaq” during an argument regarding divorce are a valid issuance of three divorces.[1] This is also in accordance with the Maliki, Shafi’i and Hanbali opinions on three divorces issued in one sitting.[2]

 

Understand that this ruling is based on what is apparent to the outside observer of the situation, and the judiciary can only rule on the apparent since there is no way to know the true reality of your husband’s mind. This is why, though he may be believed in the matter between him and Allah (ﷻ) that he is not guilty of the sin of three divorces issued in one sitting, according to the judicial ruling he is divorced three times and his claim that he didn’t mean what he clearly said is not believed.[1]

 

This ruling has been authentically narrated from the Sahabah (﵁), and specifically Umar ibn Khattab (﵁) during his caliphate.[2] He ruled that three issuances of divorce count as three divorces, not one, and the Sahabah during the time and Tabiee and subsequent great scholars after him did not object to this ruling but rather agreed and followed it.[2] The fact that the Sahabah (﵁) did not object proves that the ruling was valid, whether it was due to an abrogation of the earlier ruling or some other reason which they understood.[2] As those of later times are of course much less knowledgeable regarding the intentions and nuances of the rulings of the Messenger of Allah (ﷺ), the correct course of action is to follow the clear authentic ruling of Umar ibn Khattab (﵁) and the Sahabah (﵁) and early scholars on this matter.

 

As an aside, this ruling appears to be due to the decline in the behaviour of people generally after the time of the early Sahabah (﵁).[2] It is undeniable that the behaviour of people in the current era is generally worse than those early generations, not better, and so a ruling based on general bad behaviour would still stand.

 

Due to this being a ruling with a level of consensus from the Sahabah (﵁) at the time of Umar ibn Khattab (﵁), and also the early great scholars and jurists after them, the scholars mention that it is invalid to go against this ruling and rule by the idea that three is equivalent to one, and so if a judge rules such it will not be valid.[2] If you still wish to consider alternatives regardless of this, you must consult a learned scholar who holds an alternative opinion.[3]  

 

With the occurrence of three divorces as mentioned, you are now fully and irrevocably divorced from your husband.[4] Assuming you are not pregnant, you must begin observing your iddah of three menstrual periods (or three months if you do not menstruate) from the time of the issuance, and you will be unable to remarry your ex-husband in the near future.[4]

 

This is a very difficult and unfortunate situation, and so it is understandable if this result causes you distress. You should seek patience and help from Allah (ﷻ) regarding your suffering, and hope for great reward from Allah (ﷻ).

 

Allah’s Messenger (ﷺ) said: “There is no trouble that comes to a believer except that it obliterates from his sins, even if it is the pricking of a thorn.”[5]

 

The Messenger of Allah (ﷺ) said: “When Allah wants good for his slave, He hastens his punishment in the world. And when He wants bad for His slave, He withholds his sins from him until he appears before Him on the Day of Judgement.” And with this (same) chain, (it was reported) from the Prophet (ﷺ) who said: “Indeed greater reward comes with greater trial. And indeed, when Allah loves a people He subjects them to trials, so whoever is content, then for him is pleasure, and whoever is discontent, then for him is wrath.”[6]

 

In Surah Baqarah, Allah (ﷻ) says: “Allah does not burden any soul with more than it can bear. For him is what he has earned, and on him what he has incurred.” [2:286] [7]

 

May Allah (ﷻ) grant you and your ex-husband patience and steadfastness.

وفيها إذا سئلنا عن مذهبنا ومذهب مخالفنا قلنا وجوبا: مذهبنا صواب يحتمل الخطأ ومذهب مخالفنا خطأ يحتمل الصواب. وإذا سئلنا عن معتقدنا

قوله: عن مذهبنا) أي عن صفته فالمعنى إذا سئلنا أي المذاهب صواب ط.

قوله: مخالفنا) أي من خالفنا في الفروع من الأئمة المجتهدين.

قوله: قلنا إلخ) لأنك لو قطعت القول لما صح قولنا إن المجتهد يخطئ ويصيب أشباه: أي فلا نجزم بأن مذهبنا صواب ألبتة ولا بأن مذهب مخالفنا خطأ ألبتة، بناء على المختار من أن حكم الله في كل مسألة واحد معين وجب طلبه. فمن أصابه فهو المصيب ومن لا فهو المخطئ. ونقل عن الأئمة الأربعة: ثم المختار أن المخطئ مأجور كما في التحرير وشرحه. مطلب يجوز تقليد المفضول مع وجود الأفضل

ثم اعلم أنه ذكر في التحرير وشرحه أيضا أنه يجوز تقليد المفضول مع وجود الأفضل. وبه قال الحنفية والمالكية وأكثر الحنابلة والشافعية. وفي رواية عن أحمد وطائفة كثيرة من الفقهاء لا يجوز. ثم ذكر أنه لو التزم مذهبا معينا. كأبي حنيفة والشافعي، فقيل يلزمه، وقيل لا وهو الأصح اهـ وقد شاع أن العامي لا مذهب له

إذا علمت ذلك ظهر لك أن ما ذكر عن النسفي من وجوب اعتقاد أن مذهبه صواب يحتمل الخطأ مبني على أنه لا يجوز تقليد المفضول وأنه يلزمه التزام مذهبه وأن ذلك لا يتأتى في العامي

وقد رأيت في آخر فتاوى ابن حجر الفقهية التصريح ببعض ذلك فإنه سئل عن عبارة النسفي المذكورة، ثم حرر أن قول أئمة الشافعية كذلك، ثم قال إن ذلك مبني على الضعيف من أنه يجب تقليد الأعلم دون غيره

والأصح أنه يتخير في تقليد أي شاء ولو مفضولا وإن اعتقده كذلك، وحينئذ فلا يمكن أن يقطع أو يظن أنه على الصواب، بل على المقلد أن يعتقد أن ما ذهب إليه إمامه يحتمل أنه الحق. قال ابن حجر: ثم رأيت المحقق ابن الهمام صرح بما يؤيده حيث قال في شرح الهداية: إن أخذ العامي بما يقع في قلبه أنه أصوب أولى، وعلى هذا استفتى مجتهدين فاختلفا عليه الأولى أن يأخذ بما يميل إليه قلبه منهما. وعندي أنه لو أخذ بقول الذي لا يميل إليه جاز؛ لأن ميله وعدمه سواء، والواجب عليه تقليد مجتهد وقد فعل

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ سَعْدِ بْنِ سِنَانٍ، عَنْ أَنَسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏”‏ إِذَا أَرَادَ اللَّهُ بِعَبْدِهِ الْخَيْرَ عَجَّلَ لَهُ الْعُقُوبَةَ فِي الدُّنْيَا وَإِذَا أَرَادَ اللَّهُ بِعَبْدِهِ الشَّرَّ أَمْسَكَ عَنْهُ بِذَنْبِهِ حَتَّى يُوَفَّى بِهِ يَوْمَ الْقِيَامَةِ ‏”‏ ‏.‏ وَبِهَذَا الإِسْنَادِ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏”‏ إِنَّ عِظَمَ الْجَزَاءِ مَعَ عِظَمِ الْبَلاَءِ وَإِنَّ اللَّهَ إِذَا أَحَبَّ قَوْمًا ابْتَلاَهُمْ فَمَنْ رَضِيَ فَلَهُ الرِّضَا وَمَنْ سَخِطَ فَلَهُ السَّخَطُ ‏”‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ ‏.

لَا يُكَلِّفُ ٱللَّهُ نَفْسًا إِلَّا وُسْعَهَا ۚ لَهَا مَا كَسَبَتْ وَعَلَيْهَا مَا ٱكْتَسَبَتْ ۗ رَبَّنَا لَا تُؤَاخِذْنَآ إِن نَّسِينَآ أَوْ أَخْطَأْنَا ۚ رَبَّنَا وَلَا تَحْمِلْ عَلَيْنَآ إِصْرًۭا كَمَا حَمَلْتَهُۥ عَلَى ٱلَّذِينَ مِن قَبْلِنَا ۚ رَبَّنَا وَلَا تُحَمِّلْنَا مَا لَا طَاقَةَ لَنَا بِهِۦ ۖ وَٱعْفُ عَنَّا وَٱغْفِرْ لَنَا وَٱرْحَمْنَآ ۚ أَنتَ مَوْلَىٰنَا فَٱنصُرْنَا عَلَى ٱلْقَوْمِ ٱلْكَـٰفِرِينَ
