Can A Person Change Madhabs In Order To Invalidate A Nikah?

Question:

 

I have never formally followed a specific madhhab and am unsure whether one may choose a madhhab based on personal convenience.

 

A Muslim man (not an imam) conducted our marriage. He mentioned the names of the bride, groom, and their fathers, stated the mahr, and asked for acceptance. The groom said “Qabul” three times, and the bride also said “Qabul” three times. Present were the conductor, the bride and groom, one adult male witness, and two adult female witnesses. The bride was 17 years and 4 months old, the groom 21. Both consented. No wali from the bride’s side was present, and the families were not informed at the time. From our circumstances, it would be better for our future if the marriage is not valid.

 

Is this marriage valid according to Shariah?

 

If it is valid in the Hanafi madhhab but invalid in the other three due to absence of a wali, can we follow another madhhab and consider it invalid?

 

Is choosing a madhhab for convenience permissible?

Answer:

 

Nikāh Without a Wali

According to the Hanafi Madhhab, it is valid for a free, mature, and sane woman to marry herself off without a Wali if the necessary conditions of Nikāh are met, such as the offer and acceptance (Ījāb and Qabūl) and the presence of two witnesses. [1] Based on this, your Nikāh was valid, and all the rulings of marriage, including divorce and inheritance, apply to your relationship. [2]

 

Once a woman is adult (baligha) and sane (‘aqila), the father’s guardianship (wilayah) of compulsion over her ends and she gains the right to contract her own marriage. [3]

 

And if you notice the pronouns in the following verse, Allah (ﷻ) attributes the action of marriage to the women:

 

When you divorce women and they have reached the end of their waiting period, do not ˹let the guardians˺ prevent them [i.e. women] from re-marrying their husbands if they come to an honourable agreement. (Al-Baqarah 2:232)

 

Switching Madhhab for Convenience

Choosing (Talfīq) a Madhhab for convenience is not permissible. [4, 5] You had chosen to get a Nikāh done according to the Hanafi Madhab. It is impermissible for you to go back on that and switch your Madhab because of convenience because that necessitates following desire and whims. [5] The Fatwa of one school will not invalidate the Fatwa of another. [6, 7] Since you opted to get the Nikāh done according to the Hanafi Madhab, the Hanafi opinion is adopted and the rest are invalid for you to follow. If you wish to end your marriage, please request your husband for divorce (Talāq), or offer to undergo Khul’ah, or file a case in your local Islamic Shairah council.

والجامع أن ولايةَ الإنكاح إنما ثَبَتَتْ للأب على الصغيرة بطريق النيابة عنها شرعًا؛ لكون النكاح تصرفًا نافعًا متضمنًا مصلحة الدين والدنيا، وحاجتها إليه حالًا ومآلًا، وكونِها عاجزةً عن إحرازِ ذلك بنفسها، فبالبلوغ عن عقل زال العجزُ حقيقةً، وقدرتْ على التصرف في نفسها حقيقة، فتزول ولايةُ الغير عنها، وتثبت الولاية لها؛ لأن النيابةَ الشرعيةَ إنما تثبت بطريق الضرورة نظرًا، فتزول بزوال الضرورة، مع أن الحرية منافية لثبوت الولاية للحر على الحر، وثبوت الشيء مع المنافي لا يكون إلَّا بطريق الضرورة؛ ولهذا المعنى زالت الولايةُ عن إنكاح الصغير العاقل إذا بلغ، وتثبتُ الولايةُ له، وهذا المعنى موجود في الفرع، وقد قال رسول الله – صلى الله عليه وسلم -: “النِّساءُ شَقائِقُ الرِّجالِ”؛ ولهذا زالتْ ولايةُ الأب عن التصرف في مالها، وتثبت الولايةُ لها، كذا هذا.

وبالتالى، فإنَّ كلَّ واحدٍ من هذه المذاهبِ له نظام خاصٌ يعمل فى إطاره، بحيث إنّ كثيراً من مسائله مرتبطٌ بعضُها ببعض. فلو أخِذ منه حكمٌ وتُرِك حكمٌ آخر يرتبط به، لاختلّ ذلك النّظام، وحدثت حالةٌ من التّلفيق لا يقول بصحتها أحد، ومن العسير للعامىّ أن يعرفَ هذه الدّقائق، فلو فُتِح بابُ الانتقاء للعامّة، لأدى ذلك إلى فَوْضَوِيَّةٍ فى أحكام الشّريعة الغرّاء.

(فَصْلٌ يَجُوزُ تَقْلِيدُ مَنْ شَاءَ مِنْ الْمُجْتَهِدِينَ) .

ومتى عمل عبادة أو معاملة ملفقة أخذ لها من كل مذهب قولا لا يقول به صاحب المذهب الآخر فقد خرج عن المذاهب الأربعة واخترع له مذهبا خامسا فعبادته باطلة ومعاملته غير صحيحة وهو متلاعب في الدين وغير عامل بمذهب من مذاهب المجتهدين لأنه لو سئل كل مفت من أهل المذاهب الأربعة فلا يسوغ له أن يفتي بصحة تلك العبادة أو المعاملة لقد شروط صحتها عنده

ولا يفتى به لئلا يتطرق الجهال إلى هدم المذهب، وعن أصحابنا ما هو أوسع من ذلك، وهو أنه لو استفتى فقيها عدلا فأفتاه ببطلان اليمين حل له العمل بفتواه وإمساكها، وروي أوسع من هذا، وهو أنه لو أفتاه مفت بالحل ثم أفتاه آخر بالحرمة بعدما عمل بالفتوى الأولى فإنه يعمل بفتوى الثاني في حق امرأة أخرى لا في حق الأولى
