Can Divorce Occur Through Words Spoken In Jest Without Intention?

Question:

 

I and my wife were having fun and mimicking each other. My wife has a habit of saying the statement, “At least I will be free of you,” during an argument. When I say that things might get serious, she responds, “At least I will be free of you.”

On this occasion, we were simply having fun by imitating each other, so I imitated her by saying, “At least I will be free of you.” That is all I said. I did not say, “I am freeing you,” and I had no intention of divorce. We were just having fun and mimicking each other.

Would this constitute a divorce? Shaytan is really messing with my head. Please help me.

Answer:

 

Divorce is a matter which is not to be taken lightly. In a time of an argument, one must be very mindful of words of said during the heat of an argument. For divorce to occur, certain things are taken into consideration. Expression, intention, and circumstances. In the case mentioned above, the expression was allusive, the intention was not divorce, and the circumstances does not suggest it also, therefore divorce will not have taken place.
