Can One Return to Makkah on the 12th of Dhul Hijjah and Perform Rami on the 13th Without Staying in Mina?

Question:

 

If someone returns to Makkah before maghrib on the 12th, can he still come back from Makkah to do the rami on the 13th without staying the night in Mina?

Answer:

 

One of the waajib (compulsory) rites of Hajj is pelting the jamaraat (pillars). The usual manner in which this is conducted is as follows:

 

1. On the 10th day the biggest jamarah (Kubrah) will be pelted.

2. On the 11th all three jamaraat are pelted, after the sun passed it’s zenith time.

3. On the 12th all three jamaraat are pelted, after the sun passed it’s zenith time.

4. On the 13th all three jamaraat are pelted, after the sun passed it’s zenith time. [1]

 

In answer to your question, it is considered virtuous to pelt the jamaraat on the days of Tashreeq, however in this scenario, whilst it is still permissible to do rami, you would have to do all three and it would count as a nafl (voluntary) act not a waajib since you had already departed Mina before the relevant cut-off time, the obligation of the 13th Rami no longer remained upon you.

 

However, you may still voluntarily return and perform the Rami [2]. Although it is disliked to deliberately stay outside Mina during these days, there is no penalty for doing so [3].
