Looking At The Qur’an On A Mobile Phone To Correct The Imam

Question: 

 

Assalamu Alaikum wa Rahmatullahi wa Barakatuh.

 

Respected mufti saab I wanted to inquire about a matter regarding Taraweeh prayer. If the listener (saami) is engaged in the prayer, and the person standing beside him—who is not in prayer yet but is just standing there—takes out his phone during the first rak’at, opens the Quran on it, and stands there; and in case of a mistake, the listener merely moves his eyes to glance at the error—without any excessive physical action (amal-e-kaseer)—and only looks at the Quran when a mistake occurs, is such a practice permissible? Would this invalidate the prayer (make it fasid)?

Answer:

 

For an Imam to take the correction or prompting of a person who is not part of their congregation, or from the congregation who uses an outsider’s recitation to correct their Imam, renders the salah invalid. The same applies when a member of the congregation (muqtadi) uses a copy of the Mushaf (Qur’an) to correct their Imam, even if this copy is in the possession of another person, as they are still taking influence from outside the prayer.[1]

 

In addition, reading from the text of the Qur’an breaks the salah if an individual learns from what they are reading, even if they are not holding the text themself. Meaning, if the muqtadi read the text of verses which they had memorised from the Qur’an during salah, their prayer will not be invalidated. However, their prayer will be invalidated if the muqtadi had not originally memorised what they read from the text of the Qur’an.[2]

 

It should be kept in mind that, according to the Hanafi mazhab, it is Wajib for the muqtadi to not recite any Qur’an when praying behind an Imam, as doing so would be Makhruh Tahrimah (severely disliked) by consensus. In fact, reciting behind the Imam is considered makhruh even when the intent is to correct the Imam. It is the duty of the muqtadi to focus on the prayer and the recitation, and they should not distract themself by focusing on something outside the prayer.[3] 

 

“So when the Qur’ān is recited, then listen to it and pay attention that you may receive mercy.” Surah Al-A’raf (7:204) [4]

أُرْتِجَ عَلَى الْإِمَامِ فَفَتَحَ عَلَيْهِ مَنْ لَيْسَ فِي صَلَاتِهِ وَتَذَكَّرَ فَإِنْ أَخَذَ فِي التِّلَاوَةِ قَبْلَ تَمَامِ الْفَتْحِ لَمْ تَفْسُدْ وَإِلَّا تَفْسُدُ؛ لِأَنَّ تَذَكُّرَهُ مُضَافٌ إلَى الْفَتْحِ وَفَتْحُ الْمُرَاهِقِ كَالْبَالِغِ وَلَوْ سَمِعَهُ الْمُؤْتَمُّ مِمَّنْ لَيْسَ فِي الصَّلَاةِ فَفَتَحَهُ عَلَى إمَامِهِ يَجِبُ أَنْ يَبْطُلَ صَلَاةُ الْكُلِّ؛ لِأَنَّ التَّلْقِينَ مِنْ خَارِجٍ. كَذَا فِي الْبَحْرِ الرَّائِقِ نَاقِلًا عَنْ الْقُنْيَةِ

قَوْلُهُ أَيْ مَا فِيهِ قُرْآنٌ) عَمَّمَهُ لِيَشْمَلَ الْمِحْرَابَ، فَإِنَّهُ إذَا قَرَأَ مَا فِيهِ فَسَدَتْ فِي الصَّحِيحِ بَحْرٌ (قَوْلُهُ مُطْلَقًا) أَيْ قَلِيلًا أَوْ كَثِيرًا، إمَامًا أَوْ مُنْفَرِدًا، أُمِّيًّا لَا يُمْكِنُهُ الْقِرَاءَةُ إلَّا مِنْهُ أَوْ لَا (قَوْلُهُ لِأَنَّهُ تَعَلُّمٌ) ذَكَرُوا لِأَبِي حَنِيفَةَ فِي عِلَّةِ الْفَسَادِ وَجْهَيْنِ. أَحَدُهُمَا: أَنَّ حَمْلَ الْمُصْحَفِ وَالنَّظَرِ فِيهِ وَتَقْلِيبِ الْأَوْرَاقِ عَمَلٌ كَثِيرٌ. وَالثَّانِي أَنَّهُ تَلَقُّنٌ مِنْ الْمُصْحَفِ فَصَارَ كَمَا إذَا تَلَقَّنَ مِنْ غَيْرِهِ. وَعَلَى الثَّانِي لَا فَرْقَ بَيْنَ الْمَوْضُوعِ وَالْمَحْمُولِ عِنْدَهُ، وَعَلَى الْأَوَّلِ يَفْتَرِقَانِ وَصَحَّحَ الثَّانِي فِي الْكَافِي تَبَعًا لِتَصْحِيحِ السَّرَخْسِيِّ؛ وَعَلَيْهِ لَوْ لَمْ يَكُنْ قَادِرًا عَلَى الْقِرَاءَةِ إلَّا مِنْ الْمُصْحَفِ فَصَلَّى بِلَا قِرَاءَةٍ ذَكَرَ الْفَضْلِيُّ أَنَّهَا تُجْزِيهِ وَصَحَّحَ فِي الظَّهِيرَةِ عَدَمَهُ وَالظَّاهِرُ أَنَّهُ مُفَرَّعٌ عَلَى الْوَجْهِ الْأَوَّلِ الضَّعِيفِ بَحْرٌ (قَوْلُهُ إلَّا إذَا كَانَ إلَخْ) لِأَنَّ هَذِهِ الْقِرَاءَةَ مُضَافَةٌ إلَى حِفْظِهِ لَا إلَى تَلَقُّنِهِ مِنْ الْمُصْحَفِ، وَمُجَرَّدُ النَّظَرِ بِلَا حَمْلٍ غَيْرُ مُفْسِدٍ لِعَدَمِ وَجْهَيْ الْفَسَادِ، وَهَذَا اسْتِثْنَاءٌ مِنْ إطْلَاقِ الْمُصَنِّفِ، وَهُوَ قَوْلُ الرَّازِيّ، وَتَبِعَهُ السَّرَخْسِيُّ وَأَبُو نَصْرِ الصَّفَّارِ وَجَزَمَ بِهِ فِي الْفَتْحِ وَالنِّهَايَةِ وَالتَّبْيِينِ. قَالَ فِي الْبَحْرِ: وَهُوَ وَجِيهٌ كَمَا لَا يَخْفَى اهـ فَلِذَا جَزَمَ بِهِ الشَّارِحُ (قَوْلُهُ وَقِيلَ إلَخْ) تَقْيِيدٌ آخَرُ لِإِطْلَاقِ الْمُصَنِّفِ: وَعِبَارَةُ الْحَلَبِيِّ فِي شَرْحِ الْمُنْيَةِ: وَلَمْ يُفَرِّقْ فِي الْكِتَابِ بَيْنَ الْقَلِيلِ وَالْكَثِيرِ، وَقِيلَ لَا تَفْسُدُ مَا لَمْ يَقْرَأْ قَدْرَ الْفَاتِحَةِ، وَقِيلَ مَا لَمْ يَقْرَأْ آيَةً، وَهُوَ الْأَظْهَرُ لِأَنَّهُ مِقْدَارُ مَا تَجُوزُ بِهِ الصَّلَاةُ عِنْدَهُ (قَوْلُهُ وَهُمَا بِهَا) أَيْ وَجَوَّزَهُ الصَّاحِبَانِ بِالْكَرَاهَةِ. مَطْلَبٌ فِي التَّشَبُّهِ بِأَهْلِ الْكِتَابِ

وَيُفْسِدُهَا قِرَاءَتُهُ مِنْ مُصْحَفٍ عِنْدَ أَبِي حَنِيفَةَ – رَحِمَهُ اللَّهُ تَعَالَى – وَقَالَ: لَا يُفْسِدُ لَهُ إنَّ حَمْلَ الْمُصْحَفِ وَتَقْلِيبَ الْأَوْرَاقِ وَالنَّظَرَ فِيهِ عَمَلٌ كَثِيرٌ وَلِلصَّلَاةِ عَنْهُ بُدٌّ، وَعَلَى هَذَا لَوْ كَانَ مَوْضُوعًا بَيْنَ يَدَيْهِ عَلَى رَحْلٍ وَهُوَ لَا يَحْمِلُ وَلَا يُقَلِّبُ أَوْ قَرَأَ الْمَكْتُوبَ فِي الْمِحْرَابِ لَا تَفْسُدُ، وَلِأَنَّ التَّلَقُّنَ مِنْ الْمُصْحَفِ تَعَلُّمٌ لَيْسَ مِنْ أَعْمَالِ الصَّلَاةِ وَهَذَا يُوجِبُ التَّسْوِيَةَ بَيْنَ الْمَحْمُولِ وَغَيْرِهِ فَتَفْسُدُ بِكُلِّ حَالٍ وَهُوَ الصَّحِيحُ…

وَلَوْ نَظَرَ إلَى مَكْتُوبٍ هُوَ قُرْآنٌ وَفَهِمَهُ لَا خِلَافَ لِأَحَدٍ أَنَّهُ يَجُوزُ. كَذَا فِي النِّهَايَةِ
