The Ruling Of Travelling To Another Destination While Staying In A Town Near Their Residence

Question:

 

If a person travels 50 km from his hometown and stays in Town A for three days, on the second day he will undertake a journey of 200 km (going out and returning to Town A on the same day), will he be regarded as a Musaafir or a Muqeem while in Town A?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

If a person intends to travel to his final destination (which is 200km from town A) when leaving his hometown, he will be considered a Musafir (traveller) as soon as he leaves the boundaries of his hometown. Therefore, if town A is a separate town from his hometown, he will be a Musafir for the time he stays there before travelling to his final destination. He will then become Muqeem (resident) if he returns to town A with the intention of staying there for 15 days or more, or if he returns to his hometown for any duration of time. [1,2]

 

However, if the person did not have any intention of travelling to the final destination when leaving his hometown, intending only to travel to town A, then he will be Muqeem (resident) whilst staying in town A. [3] Thereafter, when intending to travel from town A to his final destination, he will become Musafir (traveller) when he passes the boundaries of town A.

 

Thus, the ruling depends on his intention. If he intended to travel to the final destination when leaving his hometown, he would be a Musafir from the time that he leaves the boundary of his hometown. If he had no such intention (i.e. his only intention when starting his journey was to travel to town A), then he would only be a Musafir when he leaves the boundary of town A with the intention of travelling to the final destination 200 km away.

جاء في البحر الرائق: «أن يقصد مسيرة ثلاثة أيام، فلو طاف الدنيا من غير قصد إلى قطع مسيرة ثلاثة أيام لا يترخص» (٤).
