Question:
Assalamu Alaikum Wa Rahmatullah,
I would like to request a fatwa regarding a personal issue involving conditional divorce.
About a year ago, my husband said to me:
“You are divorced three times if you speak to [a certain man]”, intending to prevent me from interacting with him.
Later on, I intentionally spoke to that man with the intention of causing the divorce to occur, as I wanted to end the marriage.
I would like to ask:
- Has the divorce taken effect according to Islamic law?
- If so, are the three talaqs considered final and irrevocable, making it impermissible for me to return to my husband unless I marry someone else first?
May Allah reward you for your service to the Muslim community in the UK.
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
Assuming no time limit or additional conditions were attached to the conditional Talaq, this means that the condition has been fulfilled, and thus three Talaqs have taken effect.[1]
This means that Talaq Mughalladah has occurred.[2] You and your husband are irrevocably separated and cannot remarry unless you marry another man, conjugate the marriage with him, he divorces you and your husband agrees to remarry you.[3]
Only Allah ﷻ knows best.
