Question:
My friend is Hanafi and he is getting married soon. Foolishly last year he made a statement saying that when gets married to his future wife he will give talaq. Is this valid as it was before marriage and is there a hadith which says this talaq is not valid?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
The issuance of Talaq is not valid if it is uttered in the future tense. This is regardless of whether the statement of Talaq is a conditional statement or not. In this case, the statement; “when I get married to my future wife i will give Talaq” was conditional, however the words “I will give Talaq” is in the future tense.
Thus this conditional statement will NOT cause Talaq to occur after the person’s Nikah contract is concluded.

لأن أهل اللغة قالوا إن صيغة المضارع مشتركة بين الحال والاستقبال، وكلامهم فيما يتعلق بالوضع والمشترك يدل على المعنيين جميعًا بسبيل الحقيقة، لكن يترجح أحد المعنيين بالدليل،
