Question:
Assalamualikum wa rahmatullahi wa barakatuh. Why is there a difference in ruling in Hurmat Musharaat when Inzaal happens and when Inzaal doesn’t happen? Touching and getting Shawat (انتشار الآلة) without Inzaal causes Hurmat, but, if Inzaal happens, Hurmat does not take place.

Answer:
The reason for this difference in the Hanafi Fiqh is that Hurmah Musaharah is established based on the possibility of Zina occurring. Without Inzaal, the possibility of Zina remains intact, and thus Hurmah Musaharah is established. However, with Inzaal, the possibility of Zina is lifted, and thus Hurmah Musaharah is not established [1].
